{"id":3725,"date":"2019-11-12T18:54:51","date_gmt":"2019-11-12T23:54:51","guid":{"rendered":"http:\/\/www.musingsbymichael.com\/blog\/?p=3725"},"modified":"2019-11-17T14:53:58","modified_gmt":"2019-11-17T19:53:58","slug":"daca","status":"publish","type":"post","link":"http:\/\/www.musingsbymichael.com\/blog\/2019\/11\/12\/daca\/","title":{"rendered":"DACA"},"content":{"rendered":"<p><a href=\"http:\/\/www.musingsbymichael.com\/blog\/wp-content\/uploads\/2019\/11\/DACA.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3733\" src=\"http:\/\/www.musingsbymichael.com\/blog\/wp-content\/uploads\/2019\/11\/DACA.jpg\" alt=\"DACA\" width=\"640\" height=\"427\" srcset=\"http:\/\/www.musingsbymichael.com\/blog\/wp-content\/uploads\/2019\/11\/DACA.jpg 640w, http:\/\/www.musingsbymichael.com\/blog\/wp-content\/uploads\/2019\/11\/DACA-300x200.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 18pt;\">DACA (Deferred Action for Childhood Arrivals) is now before the Supreme Court, will it stand or fall?<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 18pt;\">From the <a href=\"https:\/\/www.dhs.gov\/deferred-action-childhood-arrivals-daca\" target=\"_blank\" rel=\"noopener noreferrer\">Department of Homeland Security<\/a>, \u201c<i>On June 15, 2012, then-Secretary of Homeland Security Janet Napolitano issued a memorandum entitled \u201cExercising Prosecutorial Discretion<!--more--> with Respect to Individuals Who Came to the United States as Children,\u201d creating a non-congressionally authorized administrative program that permitted certain individuals who came to the United States as juveniles and meet several criteria\u2014including lacking any current lawful immigration status\u2014to request consideration of deferred action for a period of two years, subject to renewal, and eligibility for work authorization.<\/i>\u201d Also, \u201c<i>The Obama administration chose to deploy DACA by Executive Branch memorandum\u2014despite the fact that Congress affirmatively rejected such a program in the normal legislative process on multiple occasions. The constitutionality of this action has been widely questioned since its inception.<\/i>\u201d<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 18pt;\">So President Obama overrode Congress and now the Democrats (and some Republicans) are complaining that President Trump wants to end this program.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 18pt;\">From <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-daca-case-conservative-justices-signal-willingness-to-side-with-trump-in-oral-arguments\/\" target=\"_blank\" rel=\"noopener noreferrer\">CBS News<\/a>, \u201c<i>During highly anticipated oral arguments that lasted more than an hour, the high court&#8217;s five conservative justices suggested in their questioning and deliberations that they would uphold the administration&#8217;s controversial decision in the fall of 2017 to dismantle the Deferred Action for Childhood Arrivals program, known as DACA. The four liberal members of the court, meanwhile, expressed skepticism about the decision and the administration&#8217;s shifting justifications for making it.<\/i>\u201d<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 18pt;\">So if the Supreme Court conservatives are not swayed, then DACA will end. But, will Trump work with Congress?
