Impeachment Process

Impeachment Trial

While we are waiting for the Trump impeachment trial vote, I thought I would talk about the impeachment process.

From Wikipedia, “Impeachment in the United States is the process by which a legislature (usually in the form of the lower house) brings charges against a civil officer of government for crimes alleged to have been committed, analogous to the bringing of an indictment by a grand jury. Impeachment may occur at the federal level or the state level. The federal House of Representatives can impeach federal officials, including the president, and each state’s legislature can impeach state officials, including the governor, in accordance with their respective federal or state constitution.

Most impeachments have concerned alleged crimes committed while in office. And removal from office if convicted, is separate from the act of impeachment itself.

In impeachment proceedings, the defendant does not risk forfeiture of life, liberty, or property. According to the Constitution, the only penalties allowed to be imposed by the Senate are removal from office and (possible via separate vote) disqualification from holding any federal office in the future.” Please note I have edited the above somewhat to make it briefer and made one correction.

So Nancy Pelosi and company saying that Trump is impeached forever is not correct at all. In fact if the Senate votes that Trump is not guilty, then his being impeached means nothing. Just like someone who is indicted for a crime and then not found guilty, being indicted is not a sign of guilt by itself. And yes I know that there are political ramifications involved.

Now after reading the above some of you just might think that I think that I am a right wing conservative. Well you are most definitely wrong about that. I am in fact a moderate and I am just trying to point out the facts of the impeachment process.

If you want to know more about the impeachment process I recommend reading this very good article in the Washington Post.

At this point it is my hope that you now know how impeaching the President works and in doing so I do truly wish that we as a country start the healing process after the Senate vote. We as a nation can not continue to hash out the so called facts until this Fall. To do so would be a disservice to the creators of the US Constitution.

That is my opinion- Jumpin Jersey Mike
