It is time to sue Phil Murphy to stop the madness!

Governor Murphy has become a dictator and he must be stopped. The people who framed our state constitution never envisioned a situation such as we are now in. And thus someone who has the legal know how must step up to challenge the emergency actions taken by the governor.

The New Jersey Civilian Defense and Disaster Control Act states the following, ““Disaster” shall mean any unusual incident resulting from natural or unnatural causes which endangers the health, safety or resources of the residents of one or more municipalities of the State, and which is or may become too large in scope or unusual in type to be handled in its entirety by regular municipal operating services.

Under the Emergency Health Powers Act, “(4) the expected duration of the state of public health emergency, if less than 30 days. Such order may also prescribe necessary actions or countermeasures to protect the public’s health.
b. Any public health emergency declared pursuant to this act shall be terminated
automatically after 30 days unless renewed by the Governor under the same standards and
procedures set forth in subsection a. of this section.

So the act will self terminate after 30 days unless the governor renews it for another 30 days. The trouble is one there is no method to make the governor responsible to the legislature and two if Murphy does not wish the legislature or the people of New Jersey how he is determining why he should continue the emergency there is no mechanism to force him to do so.

To date Murphy has not disclosed the metrics that he uses for his rules to either the legislature or the public. Why he is not doing this makes myself and I am sure there are others who are wondering how he can continue to use the excuse of a public health emergency to keep acting as a dictator.

Why no one from either the New Jersey Legislature or from an organization such as ACLU or even some other public official has not gone to court to challenge Murphy’s continuing renewals of his powers under the aforementioned act. His actions must be curbed and the New Jersey Constitution and/or laws must be changed to prevent the abuse that Murphy to inflecting on the people and businesses of this state.

As a point that needs to be made the state can not force anyone to be vaccinated per “C.26:13-14 (2) No vaccine shall be administered without obtaining the informed consent of the person
to be vaccinated.
” I just want that made to be clear because when a vaccine is available I am quite sure that there will be pressure be brought to bear for all to be vaccinated.

In conclusion the emergency health act needs to have the legislature involved after 29 days before any renewal and the public must be made aware of the metrics that are being used to prevent arbitrary rules, as is happening now.
